President Imposes Regulatory Freeze

As is reportedly typical for incoming opposing political party Presidents, and as noted in Stinson Leonard Street Partner and Society member's Steve Quinlivan's post, newly inaugurated President Trump imposed a regulatory freeze yesterday as of noon EST as follows:

  • Except for emergency situations or other urgent circumstances relating to health, safety, financial, or national security matters, or otherwise, no regulation shall be sent to the Office of the Federal Register (OFR) until a department or agency head appointed or designated by the President reviews and approves the regulation.
  • Regulations that have been sent to the OFR but not published in the Federal Register must immediately be withdrawn from the OFR for review and approval subject to the above enumerated exceptions.
  • For regulations that have been published in the OFR but have not taken effect, steps shall be taken, as permitted by applicable law, to temporarily postpone their effective date for 60 days, and a further delay beyond that 60-day period should be considered via notice and comment.

According to The Hill, almost 1,500 pages of rules (reportedly nearly record-breaking) from federal agencies flooded the Federal Register on Thursday in anticipation of a freeze, capping an already bountiful run to the FR since the 2016 election. Stay tuned for more news in the next Society Alert.
