SEC Proposes Whistleblower Rule Amendments

After removing the item from its February 9 open meeting agenda, the SEC today proposed amendments to its whistleblower rules that effectively reverse amendments to the rules adopted by the Commission in September 2020 (reported on here). The Gensler administration had previously suspended implementation of the new amendments (Rule 21F-3 regarding award considerations for actions potentially covered by multiple whistleblower award programs and Rule 21F-6 regarding the SEC’s ability to consider the dollar amount of an award based on its size in its award determinations) pending its consideration of additional rulemaking (we reported on here).

Comments are due the later of 60 days after publication of the proposing release on the SEC's website and 30 days after publication in the Federal Register.
